Professor Berman's focus on Berkeley is more on "the Man" than on the metaphysics and this engaging study will therefore be of greater value to those with a historical, rather than a philosophical, interest in the good bishop. The book is aptly subtitled, particularly if we understand 'idealism' in its first, or Platonic sense , rather than (...) just in the peculiarly Berkeleyan metaphysical sense. The first three of its eight chapters deal with Berkeley's metaphysics, but the bulk of the book is concerned with extraphilosophical events in Berkeley's life, in particular with the two most significant ones: the abortive Bermuda Project and the messianic, indeed almost mystical, devotion to tar-water as a medical panacea. The doctrine of the mature minor began as an emergency exception to the rule of parental consent. Over time, the doctrine crept into cases that were non-emergent. In this essay, we show how the doctrine also developed in the context of the latter part of the 20th century, at the same time that the sexual revolution, the pill, and sexual liberation came to be seen as important symbols of female liberation—liberation that required that female minors be granted the status of (...) a mature minor. To do so moves sexual morality out of the domain of the family, where it had always been situated, and into the domain of the state. We also show how a phenomenological account of the care of the body in the family conforms to the latest in neuroscientific understandings of adolescent brain development. The family attenuates the dependency of adolescents and provides an important social contextualization for the care of the body, including the inculcation of sexual mores in adolescence. We conclude that the drive to push sexual decision making as a matter of state concern further undermines the foundations of the moral meanings of sex and sexuality. (shrink)

In all ethical discussion there is an implicit assumption that in our everyday experience we are often able to recognize, as if by direct perception, that the situation confronting us is indubitably bad or unquestionably good in an ethical sense. If, e.g. , on a bright afternoon we meet a capable Scout leader with a troop of healthy-minded boys on a hiking expedition through a beautiful district, sharing with one another as they go botanical information, and all obviously happy together, (...) we know without question that the situation, as we see it, is good. We are as certain about that fact as we are that the sun is shining and the grass green. If, however, on another occasion we witness an act of wanton cruelty perpetrated on a small boy by a bully, we immediately and indubitably see that the situation presented to us is bad. Here again we are as certain of the ethical character of what we see as we are of the fact that two people are involved in the mischief. It would be superfluous to quote illustrations to show that moral philosophers, in seeking to establish their conclusions, invariably rely on their judgment regarding the ethical character of situations such as these, the ethical character of which is so perspicuous that, to deny it would be, in Bishop Butler's phrase, “too glaring a falsity to need being confuted.”. The ability to feel pain is a property of human beings that seems to be based entirely in our biological natures and to place us squarely within the animal kingdom. Yet the experience of pain is often used as an example of a mental attribute with qualitative properties that defeat attempts to identify mental events with physiological mechanisms. I will argue that neurophysiology and psychology help to explain the interwoven biological and subjective features of pain and recommend a view of (...) pain which differs in important respects from the one most commonly accepted. This paper presents a theoretical elaboration of the ethical framework of classical capitalism as formulated by Adam Smith in reaction to the dominant mercantilism of his day. It is seen that Smith's project was profoundly ethical and designed to emancipate the consumer from a producer and state dominated economy. Over time, however, the various dysfunctions of a capitalist economy — e.g., concentration of wealth, market power — became manifest and the utilitarian ethical basis of the system eroded. Contemporary capitalism, dominated (...) as it is by large corporations, entrenched political interests and persistent social pathologies, bears little resemblance to the system which Smith envisioned would serve the common man. Most critiques of capitalism are launched from a Marxian-based perspective. We find, however, that by illustrating the wide gap between the reality of contemporary capitalism and the model of amoral political economy developed by Smith, the father of capitalism proves to be the most trenchant critic of the current order. Informed consent is required for any medical procedure although the situations in which it is given are beset by uncertainties and indeterminacies. These make medicolegal scrutiny of such situations very difficult. Although some people find the decision in the Sidaway case incomprehensible because of its continuing regard for a 'professional practice standard' in informed consent, I will argue that an important fact in many cases is the moral integrity of the doctor concerned and the pattern of his practice. This may (...) provide the only morally principled and legally accessible evidence enabling a correct decision to be made in a difficult case. Although the epistemological significance of a professional practice standard is thereby defended the 'prudent patient standard' for what counts as consent is left intact. (shrink)

The purpose of this study is to determine the relative frequency of course offerings on social issues and business ethics in American business schools. Specifically, a random sample of the curricula of 119 American business schools were analyzed in order to gauge the importance given to coursework on ethics and social issues. The findings indicated that the incidence of such courses was generally low in American business curricula, particularly at the graduate level. Until a few years ago the hope of the physicist seems on the whole to have been that he would eventually be able to exhibit a single interconnected system of perfectly deterministic causal laws. He took the relation of cause and effect in all change to be such that from a determinate antecedent state of that which changes there must necessarily follow a different subsequent state of it, and it was assumed by him that complete knowledge of the (...) antecedent state must enable exact prediction of the subsequent state. I do not think it matters here whether that which changes was taken as a limited subject of change or as the whole physical world. (shrink)
